1. Agreement to Terms
These Terms of Service ("Terms") govern your access to and use of datajackson.com and any related services (collectively, the "Site"), operated by Data Jackson ("we", "us", or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.
2. Description of Services
The Site provides information about, and access to, Data Jackson's consulting and technology services, including an AI chat assistant, contact and consultation request forms, and, where offered, financial account-linking features. Features described on the Site may be updated, changed, or discontinued at any time without notice.
3. Eligibility
You must be at least 18 years old to use the Site. By using the Site, you represent that you meet this requirement and that you have the authority to enter into these Terms on behalf of yourself or, if applicable, the company you represent.
4. Acceptable Use
You agree not to:
- Use the Site for any unlawful purpose or in violation of any applicable law or regulation
- Attempt to gain unauthorized access to the Site, its systems, or related accounts
- Interfere with or disrupt the operation of the Site or servers or networks connected to it
- Use the AI chat assistant to submit content that is unlawful, abusive, or infringes the rights of others
- Scrape, harvest, or reproduce Site content for unauthorized commercial purposes
5. AI Chat Assistant
The Site includes an AI-powered chat assistant intended to answer general questions and assist with consultation requests. Responses are generated automatically and may be incomplete, inaccurate, or out of date. The assistant does not provide legal, financial, tax, or professional advice, and you should not rely on it as a substitute for consultation with a qualified professional. 6. Financial Account Linking
Where the Site offers a feature to link a financial account (via Plaid Inc.), that feature is optional and requires your explicit consent through the linking flow. Your use of any linked account data is also subject to our Privacy Policy and Plaid's own terms and privacy policy. We are not responsible for the accuracy of data provided by Plaid or your financial institution.
7. Intellectual Property
All content on the Site, including text, graphics, logos, and software, is owned by or licensed to Data Jackson and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from Site content without our prior written consent, except as necessary to use the Site for its intended purpose.
8. Third-Party Services and Links
The Site may rely on or link to third-party services (such as OpenAI, Neon, and Plaid). We do not control and are not responsible for the content, accuracy, or practices of third-party services. Your use of any third-party service is subject to that provider's own terms.
9. Disclaimers
THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, DATA JACKSON SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SITE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
11. Indemnification
You agree to indemnify and hold Data Jackson harmless from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Site or your violation of these Terms.
12. Termination
We may suspend or terminate your access to the Site at any time, without notice, for conduct that we believe violates these Terms or is otherwise harmful to other users, us, or third parties.
13. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws principles, and any dispute arising from these Terms or the Site shall be resolved in the state or federal courts located in Texas.
14. Changes to These Terms
We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
